charles grauChuck's practice focuses on helping businesses and business owners to resolve their disputes with other business owners. With an emphasis on fiduciary relations, he regularly represents owners, shareholders, partners, members of LLCs, school districts and insurance companies in matters of litigation, public sector labor negotiations and enforcement of non-competition agreements. He is also experienced in areas of condominium law, land use and development, small business formation, consumer protection, personal injury, subrogation and products liability.

Some recent cases include:

  • 2006 - Established through trial that the general partner in a limited partnership violated his fiduciary duties to the limited partners by failing to comply with regulated housing agreements and allowing the partnership to enter default with the regulators. Upheald on appeal. Kessler v. Gleich (2007 NHSC 2006-851 - 120607).
  • 2005 - $425,000 recovery against employer for estate of a worker killed on the job by successfully employing exception to workers' compensation bar.
  • 2000-2004 - Negotiated settlements with various cell phone providers on behalf of individual and business customers victimized by unfair and deceptive practices.
  • 2002 - Successfully employed arson defense against insureds seeking $1,000,000 in damages for denial of insurance claim.
  • 1999-2001 - Along with partner, Russell Hilliard, successfully defended company against claims of fraud and inducing the breach of fiduciary duties alleged by a subsidiary of a Russian diamond mining company at trial and upon appeal to the First Circuit Court of Appeals. Invest Almaz v. Temple Inland, 243 F.3d 57 (1st Cir. 2001).

The former senior assistant attorney general and chief of the Consumer Protection and Antitrust Bureau of the New Hampshire Department of Justice, Chuck is also a former chair of the Bedford School Board.
