City of Nashua & Pennichuck Water Works, Inc.
Upton & Hatfield has represented the City of Nashua relative to its petition to acquire the Pennichuck Water Works, New Hampshire’s largest investor-owned water supply utility before the New Hampshire Public Utilities Commission. Pennichuck Corp. v. City of Nashua, 152 N.H. 729, 735 (2005).
Fryeburg Water Company. Upton & Hatfield represented the company before the Public Utilities Commission in its efforts to improve water service to residents in East Conway and recover its cost of service for those improvements. Fryeburg Water Company, 90 NH PUC 584 (2005).
Pollution Control Facility Tax Exemptions. Upton & Hatfield has represented local assessors in Berlin, Londonderry, Newington, Seabrook and Whitefield, New Hampshire, concerning property tax exemptions for pollution control facilities under RSA 72:12-a. See e.g., Appeal of Newington, 149 N.H. 347 (2003); Public Service Co. v. Seabrook, 133 N.H. 365 (1990); Appeal of Berlin, 131 N.H. 285 (1988).
USA Springs. The Town of Nottingham selected Upton & Hatfield to represent its Planning Board concerning the landmark application of USA Springs for a large ground water withdrawals. See Appeal of Nottingham, 153 N.H. 539 (2006) (related case).
Bio Energy, LLC. Upton & Hatfield, LLP represented the Town of Hopkinton relative to Bio Energy, LLC’s proposed construction and demolition debris co-generation facility. Bio Energy v. Hopkinton, 153 N.H. 145 (2005).
