Personal Injury

Upton & Hatfield is known for effective, aggressive advocacy in state and federal courts. Our trial attorneys are among the most respected and successful advocates in New Hampshire. Our personal injury attorneys represent individuals in all types of personal injury cases including:

  • Automobile accidents
  • Product liability claims
  • Boating accidents
  • Dog bites
  • Wrongful death
  • Other catastrophic losses.

As a 20-attorney firm with multiple specialties, Upton & Hatfield has the experience and financial resources necessary to bring complex cases to court, and the experience and judgment to advise you when to settle.

When we accept your case, it means that we believe that you have a meritorious claim, and we will devote all of the time and energy required to get the best possible result for you. We will acquire all of your medical records, deal with the insurance companies, hire the best experts we can find, and make the process as easy for you as possible.

We specialize in both personal injury and medical malpractice. Our experience in medical malpractice helps us to understand your medical condition and your prognosis in medical terms. We have nurses and experienced paralegals on our staff who know how the process works and will help you through it.

Whether a case will go to trial or settle is never easy to predict before conducting discovery, and depends on multiple factors such as the strength of the case and the willingness of the parties to compromise. Most cases settle, but there are no guarantees. Knowing when to settle and when to try your case requires experience and judgment. We will provide you with the information that you need to make an intelligent decision.

Representative cases

We handle all types of personal injury cases from auto accidents to products liability claims to medical malpractice. The full range of cases we handle is far too broad to list every type.

Motorcycle accident - We represented the family of an operator of a motorcycle killed by an elderly man at an intersection who claimed the motorcycle was being operated at any excessive speed. The case settled for the full amount of insurance coverage available after we had produced visual images showing his poor eyesight and proved that he could not see the motorcycle prior to the collision.

Boating accident - We represented the family of a swimmer who was struck by a power boat and killed. The operator claimed the accident happened outside the no wake zone. The case settled for the full amount of insurance coverage available after we obtained satellite positioning of the point of impact.

Dog bite - We represented a seven-year old boy bitten by a neighbor’s dog. Medical bills were under $200. The jury returned a verdict of $40,000 after we proved that the owner lied about the dog’s prior history.

Product liability - We represented the family of a man crushed by a machine at work that lacked appropriate guarding. The case settled for two million dollars after we had our expert redesign the machine to prove that a guard was feasible and would have prevented the accident.

Experience

Our trial attorneys have served as presidents of the New Hampshire Trial Lawyers Association, the New Hampshire Bar Association and numerous Bar Association committees, and are frequent speakers at seminars sponsored by these organizations.
